Bubbits Terms of Service

These Terms explain the rules for using Bubbits, including the game, our website, and related services. They apply when you accept them through the game or another agreement process. Any mandatory consumer rights you have under applicable law remain unaffected. These Terms are available in English and German. The version in the language in which you accept them applies.

1. Who We Are

Our Privacy Policy explains how we handle personal information. Accepting these Terms does not constitute consent to optional data processing.

2. Age and Accounts

Bubbits, including guest play, is for players aged 13 or older, or younger players with the required parental consent, as described in our Privacy Policy. If you are not legally able to enter this agreement yourself, your parent or legal guardian must approve your use and any purchases. Local age and consent requirements and the rules of the platform you use also apply.

Keep your login details secure, provide accurate information where requested, and contact us if you suspect unauthorized access. Do not sell, transfer, or share access to your account. You are not automatically responsible for activity that occurs without your authorization.

Guest progress is linked to a guest identity. Losing access to that identity, including after clearing local data, can prevent recovery. As explained in our Privacy Policy, guest accounts and their progress may be deleted after more than 90 days of inactivity. Where account linking is available, linking before losing access helps preserve your progress.

3. Using Bubbits

We give you a personal, non-exclusive right to use Bubbits for entertainment, subject to these Terms and any purchase conditions. We and our licensors retain the rights to the game, artwork, music, software, and other game content.

Please play fairly and respect other players. Do not:

• Harass, threaten, discriminate against, impersonate, or scam others, or share unlawful content or another person's private information.
• Use cheats, unauthorized automation, or exploits to gain an unfair advantage or manipulate rankings, rewards, or purchases.
• Interfere with servers, bypass security or access restrictions, or access another player's account without permission.
• Copy, redistribute, sell, or reverse engineer Bubbits except where we permit it or applicable law allows it.

You may share screenshots and gameplay videos, including monetized videos and streams, provided you respect others' rights and do not imply official endorsement. This permission does not cover distributing game assets separately.

Where you submit player names or other content, you remain responsible for it and retain your rights. You give us only the permission needed to store, display, transmit, and moderate that content as part of operating Bubbits. This does not give us a general right to use your content in advertising.

4. Purchases and Virtual Items

Where offered, paid content may include access to single-player content (Adventure Mode), cosmetics, virtual currency, or passes. The offer and checkout identify the seller, price, contents, and any duration, platform, or account restrictions. A purchase covers what is described in that offer; it does not include unspecified future content. A time-limited pass may require play or other stated actions to earn its rewards.

Virtual currency and items provide rights to use features within Bubbits. They are not bank deposits, cannot be cashed out, and cannot be sold or transferred outside supported game features. This does not limit any legal entitlement to a refund. Purchases are linked to your registered Bubbits account and can be used on every platform where you sign in with that account, unless the offer states a platform restriction. Redeem codes may not be sold or traded, and we may void codes obtained or distributed without our permission.

If we offer paid randomized rewards, we show the available rewards, odds, price, and relevant eligibility restrictions before purchase. Availability can vary by region and age. Randomized rewards do not guarantee a particular item unless the offer expressly says so.

You must have authorization to use the payment method. For purchases through Steam or another platform, that seller's purchase and payment terms also apply. If a transaction is refunded or reversed, the associated access, currency, or rewards may be removed to reflect the reversal. Exercising a lawful refund right is not itself misconduct.

5. Refunds and Consumer Rights

Contact the seller identified on your receipt for a refund, or contact us for help with Bubbits content. Any additional platform refund policy applies alongside your statutory rights.

Consumers in the EU generally have 14 days from entering an online digital-content contract to withdraw. For paid digital content supplied immediately, that right ends only when the legal requirements are met, including your express consent to early supply, acknowledgment of the loss of the withdrawal right, commencement of supply, and the required contract confirmation. Accepting these Terms alone does not waive that right. The seller must provide the applicable withdrawal information and process before purchase.

If digital content or services are faulty, missing, or not as agreed, applicable law may entitle you to correction, a price reduction, termination, or a refund. These rights are not replaced by a platform's voluntary refund window.

6. Updates and Availability

Bubbits may need maintenance and updates. Online features, such as online multiplayer, rankings, accounts, and purchases, require our servers, a working connection, and supported software. We will provide updates required by applicable law and our agreement with you.

We may make reasonable changes for security, technical compatibility, legal requirements, or game balance. Changes beyond those needed to keep the service as agreed will have a valid reason, impose no additional cost, and be explained clearly. Where required, we will give advance notice in a form you can keep, explaining the change and your rights. If a change negatively affects your access or use beyond a minor extent, you retain applicable rights to terminate without charge and obtain any refund due.

We do not guarantee that online features will be available for any particular period, and we may discontinue them. If we discontinue Bubbits' online services, we will announce this in the game and on our website at least 60 days in advance and stop selling paid content from the time of the announcement. Paid items and in-game currency can only be used within Bubbits; those that depend on online features cannot be used once those features have ended. Refunds are provided where required by mandatory law.

Downloadable versions of Bubbits, such as the Steam version, include offline modes (Adventure, Local VS, and Chill Mode). These modes, including Adventure content purchased on that platform, can be played without an internet connection and remain playable with the last released version after online services end, on systems supported by that version. Browser-based versions, including the Discord Activity, depend on our servers and end with the online services.

7. Restrictions and Ending Your Use

You may stop playing at any time and request account deletion through the contact above. Deletion can permanently remove progress and access linked to the account; it does not cancel a separate platform agreement or remove your statutory rights.

For a breach of these Terms, we may remove offending content, correct improperly obtained rewards, or restrict relevant features. Serious or repeated breaches may result in suspension or termination. We will consider the severity and circumstances, explain the reason, and provide a warning and opportunity to correct the problem where appropriate. Immediate action may be necessary to protect players, security, or comply with law.

Player names are checked by an automated filter, and reported content is reviewed by a person. You can report content or players you believe are illegal or break these Terms through "Report a Player" in the in-game Feedback window or by email to the contact above, which is also our point of contact for authorities and users under the EU Digital Services Act. You can reach this point of contact in English or German. When we restrict content or an account, we tell you the reason, the facts relied on, whether automated means were used, and how to challenge the decision.

You can contact us to challenge a restriction or request review.

8. Responsibility and Disputes

We are liable without limitation for intent and gross negligence, for injury to life, body, or health, for fraudulently concealed defects, under any guarantee we have given, and under the German Product Liability Act. For slight negligence, we are liable only for breach of an obligation that is essential to the proper performance of this agreement and on which you may regularly rely, and only for the typical damage foreseeable when the agreement was concluded. Otherwise, we are not liable for slight negligence. These limitations also apply to the personal liability of our representatives and agents. Your statutory rights relating to defects in digital content and services, such as correction, price reduction, or termination, remain intact.

German law governs this agreement. If you are a consumer, this choice does not remove mandatory protections of the law of your habitual residence that would otherwise apply. You may bring claims in any court available to you under applicable law. You are not required to use private arbitration or waive collective redress rights.

Please contact us if something goes wrong so we can try to resolve it. This is not a prerequisite to exercising your legal rights. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

9. Changes to These Terms

We may propose changes to reflect changes in the law or in Bubbits. We will explain material changes and when they are intended to apply, and obtain your agreement where required. Posting revised Terms or your silence alone does not establish acceptance. Changes will not apply retroactively to resolved transactions or remove rights you already have.
